Personal information” means any information that relates to a natural person and that, alone or in combination with other information, directly or indirectly allows that person to be identified.

Business Partner” refers generally to individuals who engage with Bayer, but are not Patients or Healthcare Professionals, including Bayer’s customers, vendors and other business partners.

Healthcare Professionals” include physicians, pharmacists, researchers, nurses, and other healthcare professionals that engage with Bayer, including our products and services.

"Patient" means patients of Healthcare Professionals.

"Services" means Bayer's products and services, including:

  • our websites, online services, systems and tools (the "Website"),
  • our pharmaceutical and life science products and services, and
  • online and offline activities through which we engage with you in relation to Bayer’s products and servi

This Privacy Statement applies with respect to your interactions with Bayer, both online and off-line, in relation to the Services, including:

  • via the Website,
  • through other online activities involving Bayer’s products and services, such as when you contact us or consent to be contacted by us electronically, and
  • through offline activities, such as when you call us or interact with Bayer in person, for instance, at an industry event or at a place of business.

This Privacy Statement also provides details about how you can exercise your privacy rights.

If you are a Healthcare Professional submitting the personal information of others, such as Patients, you are responsible for obtaining Patients' appropriate and valid consent to the disclosure of their information to Bayer, as may be required by law.

Your consent will remain valid for the period necessary to achieve the purposes for which it was collected and in accordance with our retention policies, unless you withdraw your consent before that time. In rare cases, we are not required to obtain consent to use your personal information. We may use your personal information without consent where authorized by law.

 

Whether you are a Healthcare Professional, Business Partner or Patient, when you use the Services provided on this Website, we will process your personal information. The way in which Bayer will process your personal information will vary based on how you engage with the Website and Services. This section explains the different ways in which Bayer processes personal information for the operation of the Services provided on this Website. Note that there are also rules about what you may or may not do on our Website, and these are set out in our conditions of use.

3.3.1 What Are Cookies?

Cookies, scripts, pixel tags, etags, web beacons and other similar technologies (“cookies”) are small bits of data that are stored on your computer that enable our Website to provide the Services to you. 4. Processing of Information of Healthcare Professionals

4.1 Healthcare Professionals: Collection of Your Personal Information

If you are a Healthcare Professional, we collect your personal information when you provide it to us, through registration, completion of forms, as part of an order for products or services, in e-mails, inquiries or requests and similar situations in which you may choose to provide the information to us. The specific information you might choose to provide to us will depend on the manner in which you engage with us, and could include your name, contact information, image, demographic information, professional and career information, your expertise and special interests, information about your use and engagement with our Services, events and programs, information about your online engagement, financial and payment information, or communication preferences.

In some cases, we do not collect your personal information from you directly but instead through other means. Bayer may collect personal information about you from our sales, advertising and business partners, where the law allows. For example, where you have provided your consent to our service providers and data partners to collect and share certain personal information with us, or they are otherwise authorized by law to do so, we may collect this information from them. We may also collect data about you that is publicly available in online directories or other websites. If you interact with our Website or other digital features, we may automatically collect technical data about you. Generally, if you are a Healthcare Professional, we collect your information for the following purposes:

  • establishing and maintaining our business relationship with you,
  • supplying you with the requested Services, or
  • for other purposes for which you have given your consent, except where otherwise prohibited by law.

4.2 Healthcare Professionals: Processing of Your Personal Information

The specific manner in which we process your personal information will depend on your relationship with us. Bayer may process your personal information for the following purposes:

If you are a Healthcare Professional that acts as a customer or vendor to Bayer, Bayer may process your personal information as set out in Section 6 – Processing of Information of Business Partners in order to:

  • process your orders, and initiate and fulfil our contracts with you;
  • receive and compensate you for your services; and/or
  • perform accounting.

Additionally, we use personal information you provide to Bayer or that we obtain about you from other sources in order to manage and maintain our relationships with you, including to:

  • Better understand your interests and preferences;
  • Inform you about Bayer Services that might be of interest to you;
  • Better provide you with support you may need; and
  • To validate your eligibility to access certain Website content.

We use a variety of tools and systems to assist us with fulfilling these purposes. These tools and systems are provided by third party service providers. They include: 

Customer relationship management (CRM) systems: Any personal information you provide to Bayer directly, or that is collected by us from other sources may be maintained in our customer relationship management (CRM) systems. 

Data access tools: We use third party tools in order to access your personal information, where you have provided your consent for those services to share your information with us, or where otherwise authorized by law. This includes your contact information, image, information about your professional interests, activities, and online engagement. We use this information to:

  • better understand your research and professional interests and activities; and
  • contact you in a professional capacity.

Data analysis tools: We use third party tools and data partners to access analytics regarding your interests, preferences, and behaviour, where you have provided your consent for those services to share your information with us, or where otherwise authorized by law. We use these insights to:

  • better understand your preferences regarding the manner in which Bayer engages with you; and
  • better understand, in the aggregate, prescribing demographics and behaviour, in order to improve our products and other Services.
To create your online account

Personal information may include:

  • Your contact information (e.g., name, title, form of address or salutation, address, gender, telephone numbers, email address);
  • Access credentials (e.g., login, password);
  • Accounting data (e.g., purchased goods and services, bank details, customer number, tax identification number, tax category);
  • Details on your profession (e.g., job title, position, place of work, department, practice, specialty, education, certification, accreditation, association); and
  • Expertise and special interest (such as degrees, therapeutic specialty, specific disease expertise, practice setting, years of practice, department).

We provide Healthcare Professionals tailored content on our Website. As a result of Bayer's legal obligations, in order to access this content, Healthcare Professionals must validate their eligibility and create an account. 

In this context, we process your personal information in order to:

  • Validate your eligibility to access Healthcare Professional-tailored content;
  • Create your account on our Website;
  • Enable your log in as a registered user; and
  • Administer the Services on our Website and related technical administration.

This processing is necessary for us to deliver you with the Services you request via our Website. 
With your consent, we may also use your account information to provide you with marketing.

To conduct electronic marketing

Personal Information processed for electronic marketing purposes may include:

  • The information you provide to subscribe to electronic marketing lists, such as your title, name, email address and personal/professional interests;
  • Details on your profession (e.g., job title, position, place of work, department, practice, specialty, education, certification, accreditation, association);
  • Expertise and special interest (such as degrees, therapeutic specialty, specific disease expertise, practice setting, years of practice, department); and
  • Consumer and professional preferences and comments, including with respect to Bayer Services.

For profiling purposes, we use data that we receive from you as part of our business relationship. This includes:

  • Purchase history; and
  • Cookie data, including browsing data and usage data regarding your engagement with our electronic messages.

When you subscribe to receive emails or other electronic communications from us, or where we are otherwise permitted to do so by applicable law, we process your personal information to:

  • Contact you via e-mail or other channels (phone, email, SMS, mail, social media messages);
  • Process your subscription. If you would like to receive emails or other electronic communications from us, and provide your express consent for this purpose;
  • Present you with information that could be of interest to you, and seamlessly over various channels (phone, email, SMS, mail, social media messages) without sending redundant information. For example, we may use the combination of your email address and certain browsing data to provide you with information about a product you look up on one of our websites. Based on the information we collect, we may internally indicate that you are interested in certain categories of information;
  • Optimize and personalize our customer relationship management. We may use profiling procedures to optimize and personalize our customer relationship management and our promotional activities. To do so, we may create customer profiles and assign customers to specific customer segments on the basis of these customer profiles. On the basis of this segmentation, we can manage the type, content and frequency of specific promotional activities for specific target groups; and
  • To measure and evaluate your interaction with our electronic communications (in particular by measuring and evaluating the open and click rate in email newsletters or other commercial messages).

The processing is based on your consent you provided to us in the course of the subscription process or otherwise a permitted by applicable law. You have the right to withdraw your consent at any time, e.g., by emailing privacycanada@bayer.com or by sending a written request to privacycanada@bayer.com or by clicking “unsubscribe” at the bottom of an email we send you. 
If you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages, such as notifications regarding our business relationship with you, important notices regarding our services, or as otherwise consistent with applicable law.

For event management

Depending on the event, personal information may include:

  • Your contact information (e.g., name, title, form of address or salutation, address, gender, telephone numbers, email address);
  • Details on your profession (e.g., job title, position, place of work, department, practice, specialty, education, certification, accreditation, association);
  • Expertise and special interest (such as degrees, therapeutic specialty, specific disease expertise, practice setting, years of practice, department);
  • Information about your travel to the event (e.g., hotel accommodation, flights, transportation); and
  • Your bank account data (where you will be compensated or be reimbursed for your attendance).

Where you participate in, speak at or otherwise attend an event that we provide or for which we act as a sponsor, we may receive and process certain information about you. 
We use this information to:

  • Register you and enable your participation in the event;
  • Administer travel arrangements for the event; and
  • Administer payments to you, where you are a compensated speaker or qualify for reimbursement of your cost of participation.
To respond to your inquiries, complaints and other communications.

Personal information you enter and submit via one of our contact forms or through your other communications to us, including:

  • Your contact information (e.g., name, title, form of address or salutation, address, gender, telephone numbers, email address) and any other information you provide when you make a complaint or inquiry;
  • Details on your profession (e.g., job title, position, place of work, department, practice, specialty, education, certification, accreditation, association);
  • Expertise and special interest (such as degrees, therapeutic specialty, specific disease expertise, practice setting, years of practice, department); and
  • Any further information you provide to us, e.g., in the process of your request or which is otherwise required to answer your request.

When you enter and submit your data via one of our contact forms or contact us otherwise, e.g., in the context of a service request or via the contact form we provide on our Website, your personal information will be processed to:

  • Handle your specific request, complaint, inquiry or feedback, e.g., by answering or forward your request to a competent department.

This processing is necessary for us to answer your inquiry in a quick and competent manner, and to provide you with customer service. Information you provide to us in this context will only be processed for the purpose of responding to your inquiry.

To comply with our legal and regulatory obligations, and protect the public, including for purposes of pharmacovigilance (PV) reporting.Personal information may include any personal information you provide to Bayer directly, or that is collected by us from other sources.

We may use or disclose your personal information in order to:

To conduct research and develop and improve our Services

The data we use varies broadly depending on the specific purpose for the relevant research. 
Personal information of Healthcare Professionals may include:

  • Your contact information (e.g., name, title, form of address or salutation, address, gender, telephone numbers, email address, date and place of birth, country of birth, nationality, etc.);
  • Accounting data (e.g., purchased goods and services, bank details, customer number, tax identification number, tax category, etc.);
  • Details on your profession (e.g., job title, position, place of work, department, practice, specialty, education, certification, accreditation, association);
  • Expertise and special interest (such as degrees, therapeutic specialty, specific disease expertise, practice setting, years of practice, department);
  • Physician level aggregated prescription data; and
  • Consumer and professional preferences and comments, including with respect to Bayer Services.

Personal information of your Patients may include:

  • Contact information (e.g., name, title, form of address or salutation, address, gender, telephone numbers, email address, date and place of birth, country of birth, nationality, etc.);
  • Health information (e.g., diagnosis, existence of an illness or disability, details about adverse events, treatment history, relevant health parameters, etc.); and
  • Clinical trial data, including demographic, medical and health information of Patients.

This information is obtained from multiple sources including:

  • Third party data service providers;
  • Data that must be reported to Health Canada and other regulatory bodies;
  • Sensitive health and patient data provided to Bayer through PV reporting and adverse event reports, recalls or other notifications; and
  • Through Bayer chat boards, health centers, customer and professional contact forms and call centres.

Bayer conducts research in order to:

  • develop and apply measures to prevent, diagnose, treat, recover, or cure diseases, illness, injuries, and other physical and mental impairments;
  • test and analyze our Services for efficacy, safety and enhancements; and
  • better understand the healthcare and life sciences industries and the preferences of Healthcare Professionals, Patients and Business Partners, through surveys, market analyses, and scientific research.

In this context, your personal information, and the personal information of your Patients, may be processed to:

  • Contact you to ask for your feedback;
  • Facilitate or administer the research or survey;
  • Analyze data, identify trends and issues and create statistical reports; and
  • Test and analyze our Services for efficacy, safety and enhancements.

If possible, we pseudonymize or even anonymize personal information before or in the course of our analyses. 
We may also collaborate with other companies or institutes in the case of scientific research. In such cases, we enter into specific agreements with these third parties to preserve the confidentiality of your data. 
In certain circumstances, we use third party data analysis tools to access analytics regarding your interests, preferences, and behaviour, where you have provided your consent for those services to share your information with us, or where otherwise authorized by law. We use these insights to:

  • better understand your preferences regarding the manner in which Bayer engages with you; and
  • better understand, in the aggregate, prescribing demographics and behaviour.

These insights are used to improve our products and other Services. 
We process your and/or your Patients' information on the basis of express consent where the information is sensitive (for instance, health information).

To manage visits to our facilities

Personal information may include:

  • Your contact information (e.g., name, title, form of address or salutation, address, gender, telephone numbers, email address);
  • Details on your profession (e.g., job title, position, place of work, department, practice, specialty, education, certification, accreditation, association);
  • Details on the visit to our facilities (e.g., data of visit, purpose of visit, contact person at our facilities); and
  • Where necessary for security purposes, images and videos.

When you visit our facilities, we might process your personal information as part of our visitor management, including to:

  • Offer you a parking space;
  • Provide you with internet connectivity to our Wi-Fi Network; and
  • To administer and maintain a series of technical and organizational measures, including CCTV in some circumstances, to protect our facilities, preserve our rights, and detect the unauthorized external transfer of our data assets (including intellectual property) from within Bayer.

5.1 Patients: Collection of Your Personal Information

  • Health information (e.g., diagnosis, existence of an illness or disability, details about adverse events, treatment history, relevant health parameters, etc.); and
  • Clinical trial data, including demographic, medical and health information of Patients.

This information is obtained from multiple sources including:

  • Data that must be reported to Health Canada and other regulatory bodies;
  • Sensitive health and patient data provided to Bayer through adverse event reports, recalls or other notifications;
  • Through Bayer chat boards, health centers, customer and professional contact forms and call centres; and
  • Specific research activities and programs (e.g., clinical trials).

Bayer conducts research in order to:

  • develop and apply measures to prevent, diagnose, treat, recover, or cure diseases, illness, injuries, and other physical and mental impairments;
  • test and analyze our Services for efficacy, safety and enhancements; and
  • better understand the healthcare and life sciences industries and the preferences of Healthcare Professionals, Patients and Business Partners, through surveys, market analyses, and scientific research.

In this context, your personal information may be processed to:

  • Facilitate or administer the research or survey;
  • Analyze data, identify trends and issues and create statistical reports; and
  • Test and analyze our Services for efficacy, safety and enhancements.

If possible, we pseudonymize or even anonymize personal information before or in the course of our analyses. 

We may also collaborate with other companies or institutes in the case of scientific research. In such cases, we enter into specific agreements with these third parties to preserve the confidentiality of your data.

  • Details on the visit to our facilities (e.g., data of visit, purpose of visit, contact person at our facilities); and
  • Where necessary for security purposes, images and videos.

When you visit our facilities, we might process your personal information as part of our visitor management, including to:

  • Offer you a parking space;
  • Provide you with internet connectivity to our Wi-Fi Network; and
  • To administer and maintain a series of technical and organizational measures, including CCTV in some circumstances, to protect our facilities, preserve our rights, and detect the unauthorized external transfer of our data assets (including intellectual property) from within Bayer.

 

7. Retention

We only retain personal information for as long as is necessary for us to fulfil the purpose for which it was collected or to comply with legal or regulatory requirements.

Under certain circumstances, your personal information may also be kept longer, e.g., in connection with a litigation hold, in which case we are obliged by law to preserve information until the litigation is finally resolved).

 

8. Sharing Personal Information and Recipients of Personal Information

Bayer may share and disclose personal information collected from you, from third parties and via automated means in the following circumstances:

Bayer Network: Bayer is part of the Bayer Group - a global company. Bayer may transfer any information received to one or more of its affiliated companies in other countries and regions of the world. We do not sell or transfer the information you send to us to others outside of our company.

Service Providers: Like many businesses, Bayer uses third-party service providers to assist in administering and providing the Website and our Services. Service providers assist Bayer in data storage and security, website hosting, marketing, data analytics, customer service, mailing, payment processing.

Bayer has contracts in place with its service providers that prohibit them from using personal information for anything other than providing their services to Bayer. The contracts also prohibit our service providers from passing on your personal information for use by third parties in any form whatsoever, unless we have obtained your consent or are legally required to do so.

Business Transfer: As permitted by law, Bayer may transfer or assign your personal information as a result of, or in connection with a merger, consolidation, change in control, transfer of assets, bankruptcy, reorganization, liquidation or other business transaction.

Legal Requests and Obligations: Bayer may disclose personal information when required or permitted by law, such as to respond to court orders, subpoenas or other legal processes by authorities with jurisdiction. Bayer may also disclose personal information to meet its obligations to health and drug regulators.

 

9. Transfers of Information to Other Jurisdictions

Your personal information may be stored or processed outside of Canada or Quebec, such as the United States and Europe. The data protection laws of these jurisdictions may differ from Canadian or Quebec laws. Subject to applicable laws in such other jurisdictions, we will ensure that appropriate protections are in place to require the data processor in that country to maintain protections on the data that are equivalent to those that apply in Canada.

 

10. Protection of Personal Information

Bayer uses physical, technical and organizational security precautions to protect your personal information from manipulation, loss, destruction or unauthorized access, use, disclosure or alteration. Third parties that process personal information on our behalf are contractually obligated to safeguard personal information and only use the information provided to them for the purposes outlined in this Privacy Statement.

Our security procedures are continuously revised based on new technological developments.

Bayer has established and implemented governance policies and practices regarding the protection of personal information. These policies and practices are proportionate to the nature and scope of our activities and are approved by our Privacy Officer.

For instance, Bayer:

  • follows internationally recognized standards for cybersecurity and information security, and requires that personal information at the end of its lifecycle be securely destroyed;
  • has policies in place which define the roles and responsibilities of the members of its personnel throughout the life cycle of the information, including role-based access and retention periods,
  • ensures that all personnel complete privacy training; and
  • provides a process for dealing with complaints regarding the protection of personal information (see section 14 of this Privacy Statement)

 

11. Automated Decision Making

We do not use automated decision-making within the meaning of Canadian privacy law. We do engage in profiling of Healthcare Professionals, as described above (see section 4.2). If we make use of automated decision-making or profiling, you will also be informed through a separate privacy notice.

 

12. Minors

In order to protect children's privacy, we do not collect, process or use on our Website any personal information relating to an individual whom we know to be under fourteen (14) years old without the prior, verifiable consent of his or her legal representative. Such legal representative has the right, upon request, to view the personal information provided by the child and/or to require that it be deleted.

If you are providing us with personal information of individuals under the age of fourteen (14) you represent that you have the appropriate authority to do so, and that you can demonstrate such authority to Bayer upon request.

If you are a parent or guardian who has discovered that your minor child has provided us with personal information, we ask that you contact us at privacycanada@bayer.comto have this information deleted from our records.

 

13. Obligation to Provide Personal Information

In general, Patients, Healthcare Professionals and Business Partners are neither contractually nor statutorily required to provide personal information to Bayer for the above purposes. However your decision to not provide your personal information may reduce features and functionalities available to you, make it impossible to use our information and Services, or result in the denial of access to our Services and/or exclusion from our business activities to the extent the processing of your personal information is key in these contexts.

The information required for registration on our Website or for contacting us is marked as mandatory in the corresponding area (e.g., a contact form) of the Website; if you do not provide this mandatory information, we cannot enable you to use these functionalities.

 

14. Your Privacy Rights

Right of access: You have the right to obtain information on the processing of your personal information and in some cases, to receive a copy of this data. If you have an account with Bayer, you can update or make changes to your personal information by logging into your profile.

Right to rectification: You have the right to request that we correct or complete your inadequate, incomplete or inaccurate personal information.

Right to erasure: Under certain circumstances, you have the right to request that we delete your personal information.

Right to request information: You have the right to request information about data processing, including what personal information was collected from you and how it is being processed.

Right to be forgotten: You have the right to request that we cease disseminating your personal information or have hyperlinks associated with your name and that provide access to personal information, de-indexed in certain circumstances.

Right to complain: You have the right to lodge a complaint with a supervisory authority against the processing of your personal information if you believe that the processing of your personal information violates data protection regulations.

Right to withdraw consent: In circumstances where you granted us your consent to process your personal information, you may withdraw your consent:

  • to the use of your personal information in the future, and
  • to the communication of your information to third parties.

We will then stop the processing of your personal information, subject to legally permissible exceptions. Please note that your withdrawal has effect for future processing operations only.

If you withdraw your consent, you may no longer be able to use the Services affected by the withdrawal. Apart from that, you will not suffer any further disadvantages.

You have the right to withdraw your consent at any time.

When you exercise your rights by submitting a request to us, we will verify your identity by asking you to authenticate your identity via standard authentication procedures. For example, we may ask for your email address, order numbers of previous orders of our products and services, the last four digits of a credit or debit card or bank account number used to make a purchase, or the date of your last purchase from us.

We will respond to your request in writing within the time required by law (generally within thirty (30) days). In certain cases, for instance, when the request involves large volumes of information or we must contact multiple third parties to obtain the information requested, we may need additional time to respond.

For an access request, we will provide you with access to your personal information that is in our possession, subject to certain exceptions (such as when your request includes another individual’s personal information that we cannot sever, information subject to solicitor-client privilege, or other legal restrictions that may prevent us from fulfilling your access request).
